NOTICE: We may collect, process, and disclose certain categories of sensitive personal data, including biometric or biometric-derived information, solely for purposes permitted by applicable law and, where required, with your consent. We do not use such information for identity verification unless expressly stated, and we do not sell sensitive personal data except as defined and permitted under applicable privacy laws.
MyGCnow LLC (“Company,” “we,” “our,” or “us”) respect your privacy and are committed to protecting it through compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about individuals who access or use our technology platform, including our websites, applications, and related services that link to this policy (collectively, the “Platform” or our “Services”). References to “Users” mean individuals or entities that access, use, or interact with the Platform or Services, whether as homeowners, professionals, vendors, or other participants, and this policy describes our practices for using, maintaining, protecting, and disclosing personal data in connection with such use. The Services include a variety of features, tools, and capabilities designed to support the use of the Platform, some of which enable homeowners, professionals, vendors, and other independent Users to connect, communicate, collaborate, exchange information, and participate in shared project or transactional environments. Certain features of the Services may be social, interactive, or collaborative in nature, and information you submit, upload, or generate through those features may be visible to other Users in accordance with the functionality you choose to use, your account settings, and the connections you establish. The availability or use of any such features does not limit or define the full scope of the Services.
The Company operates a technology Platform and provides software-based tools and features to facilitate User access, communication, and information sharing. Except where a User separately enters into a written construction agreement with MyGCnow Construction, the trade name (also known as a “DBA”) of MyGCnow LLC when operating in the capacity of a duly licensed general contractor, the Company does not provide construction, contracting, professional, supervisory, or advisory services through the Platform and does not control or direct the performance of any User or third party. Any construction services provided by MyGCnow Construction are governed exclusively by the applicable construction agreement and any related policies or disclosures provided in connection with that agreement, and are not governed by this Privacy Policy except to the extent the Company processes personal information through the Platform in its capacity as a technology services provider. In such instances, the Platform may be used as a digital tool to support communications, documentation, or administrative workflows related to the construction engagement, in a manner consistent with how the Platform is used in connection with independent third-party service providers. This use of the Platform does not alter the independent nature of the construction agreement and does not constitute control or direction of any third party.
This policy applies only to information we collect:
- Through the Services.
- In communications, including email, text, chat, and other electronic messages, between you and the Services.
- When you interact with our advertising and applications (including mobile apps) on third-party websites and services, if those applications or advertising include links to this policy.
It does not apply to information collected by:
- Us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries) that does not link to this policy; or
- Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Services.
We may provide additional or different privacy policies that are specific to certain features, offerings, or activities. Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time. When material updates occur, we will provide reasonable notice, which may include posting a notice or updating the “Last Modified” date, and any one form of notice will be deemed sufficient. Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates. This Privacy Policy is intended to describe how we collect, use, and disclose personal data in connection with the Services and does not replace, modify, or supersede the terms of any agreement governing access to or use of the Services or other products or services we may provide.
The Personal Data That We Collect or Process
“Personal data” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information (for example, account information such as name, postal address, and email address, credit card number, social security number, or any other identifier we may use to contact you online or offline).
The types and categories of personal data we collect or process include:
- Account and contact information, including name, address (such as home address, work address, or other address), email address, phone number, username, and other contact information you provide us.
- Professional and business contact information, including company name, affiliation, job title, professional license(s) information, company bond information, insurance, and other information you provide us.
- Payment and transaction information, including bank routing numbers, tax information, credit card or debit card information, payment status, billing records, and transaction identifiers, to the extent such information is provided to or processed by the Company in connection with Services, whether processed through third-party payment processors (such as Stripe, PayPal or Venmo) or collected or processed directly by the Company pursuant to applicable supplemental agreements.
- Account history, including information about your subscription, account, transactions, purchases, order history, or discounts.
- Demographic information, including your age, gender, income level, education, or family or marital status, or other information you have provide us.
- Location information, including general geographic location (such as country, state or province, or city) and, where enabled, precise geolocation.
- Device information, including your IP address, type of browser, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
- Content and information you elect to provide as part of your profile or in any reviews you make through the Services or emails, chats, or other communications sent to us.
- Images, voice recordings, and videos collected or stored in connection with the Services, and other audio, electronic, and visual information you have provided to us.
- Identity document information, such as your social security or other government identification number, driver’s license numbers, vehicle information, and car insurance information, and other personal identifier information.
- Communication information you make through the Services, including your records of chat messages, calls, AI queries, or customer support requests, or other communications sent to us.
Some of the information identified above, including identification document information precise geolocation information, and biometric information, may be considered sensitive data under certain laws. If required under applicable law, we will collect and process sensitive personal data only with your consent. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, Services, or information. Certain features of the Services may involve the collection or processing of images, scans, recordings, or other data that could be considered biometric or biometric-derived information under applicable laws. Such information is collected and processed solely to support the functionality of the Services and is not used for identity verification purposes unless expressly stated otherwise. Where required by law, we obtain consent prior to collecting or processing biometric information.
We also collect:
- Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of Users accessing a specific Services feature.
- Project ecosystem information. As a multi-user Platform, the Services facilitate collaboration between different individuals and entities. Certain data generated through the Platform, such as timestamped communications, site photos, measurements, and change orders, are considered part of a "Project Record." To maintain the integrity of the project history for all involved Users, these records may be maintained in a non-alterable state even if one User requests account deactivation. This is necessary to ensure that all parties have access to a consistent "source of truth" for legal, safety, and compliance purposes. Information you provide, including your profile details, uploaded media, messages, and project status updates, may be visible to other Users with whom you are connected or with whom you share a project workspace. We do not control how other Users use or disclose the information you share within these collaborative environments.
- Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Services, such as clickstream information to, through, and from our Services (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.
- Insurance and compliance data. To reinforce the safety of our provided Services, we collect various insurance and compliance data from service providers, vendors, and professional Users. Data collected may include, but is not limited to, insurance information, business license, specialties, and other information, as may be applicable to the vendor. The collection or availability of this information does not imply that such information is accurate, complete, or current, and Users should not rely on any posted or collected information without independent verification.
- Technical Intermediary. You acknowledge that the Platform acts as a technical intermediary for the storage of personal and project data. While we implement security measures to protect the integrity of the data, the Company does not perform independent verification of the factual accuracy or privacy compliance of information provided by Users. The responsibility for the accuracy of personal data and any incidental data captured within images or scans rests solely with the User who provided the information.
Accordingly, the Company's role is limited to providing the technical infrastructure for the following types of information: The Services allow Users to create, upload, transmit, store, and share content, including reviews, ratings, images, videos, documents, scans, estimates, messages, and other materials (“User Content”). User Content may contain personal data and may be shared with other Users, connected parties, or project participants based on the features used and permissions granted. You understand and acknowledge that content you choose to submit or share through the Services may be accessible to others and processed in accordance with this Privacy Policy.
If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.
How We Collect Your Personal and Other Data
You Provide Information to Us
We collect information about you when you interact with our Services, such as when you create or update an account, place a bid, subscribe, or create, upload, or post content to the Services, including reviews, media such as photos, videos, or audio recordings. You are responsible for ensuring that the information and content you submit through the Services is accurate, current, and submitted with any necessary rights, permissions, or legal authority. Content you submit through the Services may depict, reference, or otherwise include other individuals. You are solely responsible for ensuring that you have obtained all necessary rights, permissions, and consents to upload and share such content, including where individuals appear intentionally or incidentally. Content may also include incidental or background information, such as images of bystanders, screens, documents, whiteboards, or other materials that may contain personal, confidential, or sensitive information. You should carefully review content before uploading it to ensure that you do not disclose information you do not have the right or intent to share.
Information provided, uploaded, submitted, or generated by Users or third parties through the Platform may include project details, estimates, bids, measurements, scans, floor plans, communications, documents, and other content. Such information is provided by Users or third parties at their own discretion and responsibility. The Company does not verify, validate, or guarantee the accuracy, completeness, or reliability of User-provided or third-party content and is not responsible for how such information is used, interpreted, or relied upon by any User or third party. For purposes of applicable privacy laws, the Company processes User Content strictly as a service provider at your direction. You remain the primary owner and controller of the personal data you upload. You are responsible for ensuring you have the legal right to collect and share such data—including photos of private job sites or third-party identifiers—and you agree that the Company is not liable for privacy violations resulting from your unauthorized submission of information.
When you establish a connection with another User or invite a User to a project workspace, you are voluntarily sharing access to certain components of your personal data and User Content. Once shared in a collaborative environment, that information may be duplicated or stored within the account records of the connected User. You acknowledge that the Company cannot "un-share" or force the deletion of information that has already been lawfully transmitted to or accessed by another User through the normal functionality of the Platform. If you believe that User Content shared through the Services violates your privacy rights or was uploaded without appropriate authorization, you may contact us at [email protected]. Upon receiving such notice, we may review the content and take appropriate action consistent with our Terms of Service, this Privacy Policy, and applicable law.
Automatically Through Our Services
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal data. To support core features such as site verification, logistics, and real-time project updates, we may collect precise geolocation data from your mobile device. Depending on your device permissions, we may collect this data while the app is in the foreground (active on your screen) or in the background (running but not actively being viewed). This data is used to provide location-based services and verify activity within the Platform ecosystem. You may choose to disable location tracking at any time through your device settings; however, doing so may limit or disable certain features and services that rely on location-based verification or real-time updates.
Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, location data, logs, and other communication data, and which resources and Services features that you access and use. We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking). Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.
The technologies we use for this automatic data collection may include:
- Cookies. A cookie is a small file placed on your device when you interact with the Services. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Services.
- Web Beacons. Some parts of the Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count Users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
To the extent any of these automated technologies are considered a personal data sale, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses by emailing [email protected]. Please note that some Services features may be unavailable as a result. When you interact with the Services, there are third parties that may use automatic collection technologies to collect information about you or your device. These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your personal data or they may collect information, including personal data, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
Provided by Other Users
We may receive, store, and process limited personal information about you when a professional, vendor, or other independent User provides, uses, or uploads your contact information to their account, including from their own records or databases, for the purpose of sending an invitation or related communication to create an account or access the Services, or otherwise using such information in connection with the Services. Such information is processed solely to deliver the requested communication or to facilitate access to the Services and is not used for unrelated purposes unless otherwise permitted by this Privacy Policy or required by law. For purposes of receiving, storing and processing contact information submitted by Users, we rely on the use of the Services by the Users as an indication that they have obtained any necessary permissions or legal authority to upload, store, or provide such contact information, and we do not independently verify or monitor such permissions. Responsibility for obtaining appropriate consent or authority rests solely with the User providing the information.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal data, to:
- Provide you with the Services and any contents, features, information, products, or services that we make available through the Services.
- Process applications, transactions, and payments.
- Allow you to place bids, interact with other Users, and enter into contracts.
- Facilitate collaboration, communications, shared project environments, and data exchange among Users connected to the same project, transaction, or workflow.
- Provide customized content, offers, or Services, including marketing content via email, postal mail, social media, SMS, or other channels, subject to applicable laws. If you opt in to receive text messages from MyGCnow, we may send you transactional, operational, informational, or promotional messages related to your account, use of the Services, bookings, project activity, reminders, or other Platform-related communications. Message frequency may vary. Message and data rates may apply. You may opt out of receiving SMS messages at any time by replying “STOP” to any message. For assistance, you may reply “HELP” or contact us at [email protected]. Opting out of SMS messages will not affect your ability to receive non-SMS communications or use the Services, though certain SMS-dependent features or notifications may no longer be available. We do not share SMS opt-in data, consent records, or message originator information with third parties for purposes unrelated to providing messaging services. We may share limited information with third-party service providers, platform vendors, telecommunications carriers, or messaging processors that assist us in delivering text messages, solely to support message transmission, delivery, compliance, and system integrity. Such providers are contractually required to protect your information and use it only as necessary to provide messaging-related services.
- Research and development Services, including but not limited to training artificial intelligence chat algorithms. Any use of personal data for research, development, or training purposes is conducted in accordance with this Privacy Policy and applicable law.
- Improve our Services, including by analyzing your information and creating aggregated data derived from your information) to develop, maintain, analyze, improve, optimize, measure, and report on our Services and their features and how Users interact with them.
- Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity.
- Ensure quality control.
- Debug to identify and repair errors.
- Enforce our Terms and policies.
- Audit or other compliance activities.
- To comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim.
- For internal administrative purposes, as well as to manage our relationships.
- Provide you with notices about your account.
- Promote our Services, business, and offerings by publishing advertising on our own Services and by placing ads on third parties’ services.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- Notify you when Services updates are available and about changes to any products or services we offer or provide through them.
- Maintain Platform trust and safety. We use feedback, reviews, and rating data provided by Users to create a transparent reputation system. These ratings are visible to other Users to facilitate informed decisions. Consistent reports of policy violations or low performance ratings may be used to evaluate your continued access to the Services.
- In any other way we may describe when you provide the information.
- For any other purpose with your consent.
Who We Disclose Your Information To
We may disclose aggregated information about our Users without restriction. We may also disclose personal data that we collect or you provide as described in this privacy policy:
- To our subsidiaries and affiliates.
- To vendors, contractors, service providers, and other third parties we use to support our organization. Where we disclose personal data to service providers processing information on our behalf, we may require by contract that such providers use personal data only to provide services to us, protect the confidentiality and security of such data, and not use or disclose it except as permitted by contract or required by law.
- To other Users, professionals, vendors, or project participants with whom you choose to connect or interact through the Services, including in connection with shared projects, transactions, communications, or collaborative features. Such disclosures occur at your direction or through the functionality you elect to use, and we do not control or assume responsibility for how such recipients use or further disclose the information. The Company’s provision of technical functionality that enables User-directed sharing does not constitute control over the independent acts, decisions, disclosures, or downstream processing activities of Users or third parties who receive information through the Platform.
- To other Users in connection with ratings, reviews, testimonials, comments, or feedback you choose to submit through the Services, including disclosure of your name, username, business name, profile identifier, and associated review content, where such information is displayed as part of the Platform’s accountability, transparency, trust and safety, or reputation features. By submitting reviews or ratings through functionality that displays reviewer identity, you acknowledge that such information may be visible to other Users in accordance with the functionality of the Services.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by the Company is among the assets transferred.
- To third parties to market their products or services to you if you have not opted out of these disclosures. We do not sell or share personal information for cross-context behavioral advertising except as may be defined under applicable law, and where such laws apply, you may exercise applicable opt-out rights as described in this Privacy Policy.
- To fulfill the purpose for which you provide it, or for any other purpose disclosed by us when you provide the information.
- With your consent.
We may also disclose your personal data:
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce or apply our Terms of Service and other applicable agreements governing use of the Services, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our members, or others. We may disclose personal data where reasonably necessary to prevent death, bodily harm, fraud, security incidents, or other imminent harm, or to protect the rights, safety, or security of Users, the Platform, or the public, as permitted by law.
Payments made in connection with the Services may be processed in different ways depending on the nature of the transaction and the applicable agreement. Where Users engage independent third-party providers through the Platform, payments are made directly between those parties using third-party payment processors, and the Company does not collect, receive, hold, or process payment card numbers or financial account credentials for such transactions, nor does it act as an intermediary, funds holder, or escrow. Where payments are made directly to the Company for Services it provides, the Company may receive and process payment and transaction information directly or may elect to use one or more third-party payment processors. Any payment information processed by the Company is handled in accordance with this Privacy Policy and applicable law. Where third-party payment processors are used, the collection and processing of payment information by those processors is governed by their own privacy policies and terms, and the Company does not control or assume responsibility for their independent data practices.
Certain information you provide may be shared with other Users or third parties in connection with projects, bids, communications, or other interactions you initiate or participate in through the Platform. Such sharing occurs at your direction or as part of Platform functionality. The Company does not control and is not responsible for how other Users or third parties use, disclose, or rely upon information shared through the Platform. The Platform may integrate with or make available third-party services, tools, features, or applications, including through application programming interfaces (APIs) or other technical integrations. Information processed in connection with such third-party services is subject to the privacy policies and data practices of the applicable third-party providers. The Company does not control and is not responsible for the privacy practices, data handling, or security measures of third-party services, even where such services are accessible through or integrated with the Platform.
We use personal information to operate, maintain, and improve the Platform; facilitate communications and connections between Users; enable Platform features and functionality; process transactions; and support Platform safety, compliance, and operational integrity. We do not use personal information to provide construction, professional, advisory, or supervisory services, or to verify, certify, or guarantee project conditions, performance, or outcomes.
Your Rights and Choices About Your Information
Some jurisdictions give you a right to make the following choices regarding your personal information:
- Access. You may request access to your personal information or confirmation that we have information about you. In certain limited circumstances, you may also request to receive access to your personal information in a portable, machine-readable format.
- Correction. You may request that we correct personal information that is inaccurate or incomplete. Note that we may keep historical information in our backup files as permitted by law.
- Deletion. You may request that we delete your personal information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes. Deletion rights may also be limited where information is associated with shared or multi-party project records, communications, transactions, or other records for which retention is reasonably necessary to preserve the rights, records, safety, fraud-prevention functions, or legitimate interests of other users or the Platform, as permitted by law. Please be aware that requesting the deletion of your personal information will not result in the removal of User Content that is integrated into a multi-party project, such as bids, signed contracts, project logs, or shared media. For the protection of all Platform participants, such "Shared Records" are retained for the duration of the applicable statute of limitations or repose for construction claims in the relevant jurisdiction. While your profile may be anonymized or hidden, the historical record of the project actions remains intact.
- Opt-out of Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target audience preferences, you can opt out by sending in a request to [email protected]. We may need to verify your identity before fulfilling a request.
- Data Portability. You may request to receive a copy of your personal data in a structured, commonly used, and machine-readable format. Please note that this right applies specifically to the personal information you have provided to us. It does not extend to proprietary Platform content, which remains the intellectual property of the Company or subject to specific licensing terms.
- Objection to or Restriction of Certain Processing. In certain circumstances, you may object to the processing of your personal information, or request that we restrict processing of your personal information. This may include objecting to decisions based solely on automated processing, including profiling, and requesting human intervention in relation to an automated decision so that you can express your view and contest the decision.
- Revocation Of Consent. Where we process your personal information based upon consent, you may revoke consent. Please note, if you revoke your consent for the processing of personal information then we may no longer be able to provide you services.
- Promotional Communications. If you no longer wish to receive promotional communications from us, follow the unsubscribe instructions in the message that you receive from us. You may also adjust the settings in your account or contact us directly to revoke marketing consent to [email protected]. Note, if you decide not to receive promotional communications, we may still send you service-related communications.
- Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal data with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by sending in a request to [email protected]. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.
- Location Data. You can choose whether or not to allow the Services to collect and use real-time information about your device’s location. If you block the use of location information, some Services features may become inaccessible or not function properly.
Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law. Closing or deactivating your account does not automatically result in deletion of all personal data. Certain information may be retained as described in this Privacy Policy, including for legal compliance, dispute resolution, fraud prevention, safety, security, enforcement of agreements, and maintenance of Platform integrity, including ratings, reviews, and transaction records where permitted by law.
You may exercise the rights described above by contacting us as described in the “Contact Information” section below. To protect your privacy, we may take steps to verify your identity before fulfilling your request, such as by asking you to log in to your account, confirm your email address, or provide other identifying information. If you are a California resident, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. To do so, you must (1) provide that authorized agent written and signed permission to submit such request, and (2) verify your own identity directly with us. If you are an authorized agent submitting a request on behalf of an individual, you must contact us as described below and provide written proof that you are able to act on another person’s behalf.
Your State Privacy Rights
Depending on your state of residency, you may have certain rights related to your personal data, including:
- Access and Data Portability. You may confirm whether we process your personal data and access a copy of the personal data we process. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
- Correction. You may request that we correct inaccuracies in your personal data that we maintain, taking into account the information’s nature and processing purpose.
- Deletion. You may request that we delete personal data about you that we maintain, subject to certain exception under applicable law.
- Opt Out of Using Personal Data for Targeted Advertising, Profiling, and Sales. To the extent applicable law characterizes certain disclosures as a “sale,” you may request that we do not use your personal data for these purposes.
The exact scope of these rights vary by state. There are also several exceptions where we may not have an obligation to fulfill your request. To exercise any of these rights, please submit a request to [email protected]. Depending on where you live, you may have the right to appeal a decision we make relating to requests to exercise your rights. To appeal a decision, please send your request to [email protected]. In order to protect your personal data from unauthorized access, change, or deletion, we may require you to verify your credentials before you can submit a request to know, correct, or delete personal data. Certain information, such as ratings, reviews, feedback, and other reputation-related data, may be retained for Platform integrity, trust, safety, fraud prevention, and dispute resolution purposes, even if other personal data is deleted, to the extent permitted by law. When you request deletion of your account or personal information, we will delete or deidentify information to the extent required by applicable law. However, where permitted or required by law, we may retain limited information that is reasonably necessary for the legitimate purposes described above. This may include, for example, records relating to estimates, bids, project history, transactional records, communications, permissions, audit logs, acknowledgments, consent and policy acceptance records, fraud and security records, ratings or reviews, and other records tied to shared or multi-party interactions on the Platform. Information associated with shared projects, transactions, communications, or other multi-user activities may not be deleted solely at the request of one user where deletion would impair the rights, records, safety, fraud-prevention functions, continuity, or legitimate interests of other users or of the Platform. In those circumstances, we may retain the relevant record while deleting or deidentifying information that is not reasonably required to preserve the integrity, evidentiary value, or lawful function of that record. Where reasonably feasible, retained information is limited to what is necessary for the applicable retention purpose and is deidentified, minimized, archived, or placed in restricted-access systems. Information retained after a deletion request is maintained only for the purposes that justify its retention and is not used for marketing or other unrelated commercial purposes.
Personal information may be retained for a limited period in secure system backups and cannot be immediately deleted; however, such backups are maintained solely for continuity, security, and disaster-recovery purposes and are subject to automated retention and deletion controls, as further described below. Certain personal information may remain temporarily in secure backup or disaster-recovery systems for a limited period and will be deleted or overwritten in accordance with applicable backup-retention schedules. Backup copies are maintained for continuity, security, and disaster-recovery purposes, are not used as an active source for ordinary business operations, and, if restored, remain subject to applicable deletion and retention controls as reasonably practicable. Personal information contained within system backups is not accessed for operational use and is automatically and permanently deleted upon expiration of the applicable backup-retention period in accordance with our data-retention practices. You acknowledge that the metadata and audit logs generated by your interactions—such as the timing of communications and history of data access—are essential to maintaining the security and operational integrity of the Platform. To protect all Users and prevent fraudulent activity, this technical metadata may be retained and processed in accordance with our retention schedules even if the primary User Content is deleted, as it serves as a persistent technical record of the Platform’s processing activities. We are not responsible for circumvention of any privacy settings or security measures contained on the Services or on third-party websites. To the extent required by applicable law, we may notify affected individuals and relevant authorities of certain security incidents or personal data breaches in accordance with applicable legal requirements. Personal data may be processed or stored in the United States or other jurisdictions where privacy laws may differ from those in your jurisdiction, subject to applicable legal safeguards where required.
Artificial Intelligence (AI) and Automated Processing
Our website incorporates artificial intelligence (“AI”)-driven tools and automated processes to enhance your experience and provide informational services. Please note:
- Data submitted into AI systems may be stored for training, auditing, or safety purposes in compliance with our Privacy Policy.
